Delhi court directs registration of FIR against man for submitting forged medical documents for extension of interim bail – World News Network

New Delhi [India], September 19 (ANI): Delhi’s Saket Court has directed Delhi Police to file an FIR against a man for submitting a forged and fabricated medical report to seek extension of his interim bail. His plea of extension of interim bail was dismissed by the court.
The man identified as Trilok Chand Chaudhary is an accused in a cheating and forgery case registered by the Economic Offence Wing (EoW, South) in the year 2022. The court on Wednesday directed the applicant, Trilok Chand Chaudhary, to surrender before the jail superintendent within one day.
“It appears that the applicant has placed on record a forged and fabricated document in the court in the form of a medical prescription dated 11.09.2024. Copy of this order along with copy of prescription dated 11.09.2024 of Apollo Hospital be sent to SHO, PS Saket with direction to register FIR against the applicant and to investigate the matter,” Additional Sessions Judge (ASJ) Dr. Sugandha Agarwal said in the order passed on September 18.
ASJ Agarwal said that today the verification report has been filed by IO in the court, which is supported by the report of Dr. S.K. Gupta himself. As per said report and the certificate issued by Dr. S.K. Gupta, the applicant has never visited his OPD on 11.09.2024 and was not examined by Dr. S.K. Gupta on the said date.”
Further, a bare perusal of the medical prescription of the applicant dated 11.09.2024 and the earlier report dated 02.09.2024 by Dr. S.K. Gupta shows that two handwritings are completely different.
The further observed, ” Even the signatures of Dr. S.K. Gupta appearing on earlier medical documents are completely different from the signatures appearing on prescription dated 11.09.2024.”
“Further in all the earlier medical documents, Dr. S.K. Gupta affixed his seal along with the signatures but on the prescription dated 11.09.2024, no such seal has been affixed,” the court said.
It was submitted by the counsel for the accused that, as per the applicant, he visited the junior doctor of Dr. S.K. Gupta on 11.09.2024. However, the applicant was unable to reveal the name of said doctor whom he visited.
The court said that if that were the case, then, the name of the treating junior doctor would have been mentioned with his signatures. The above circumstances show that the applicant has placed on record a forged and fabricated prescription of the doctor in order to get a favourable order from the court.
The applicant was admitted to interim bail for a period of 4 weeks vide order dated 03.08.2024 on medical grounds.
An application was moved stating that applicant is seeking only extension of said interim bail on medical grounds. It was submitted that the applicant has a long history of chronic heart disease. He has undergone bye-pass surgery in the year 1995 itself.
It was also stated that during his custody, on 30.06.2024, his condition had deteriorated and he was rushed to the emergency department of the jail dispensary. Subsequently, as the jail dispensary was unable to manage his health, he was taken to Safdarjung Hospital several times.
The treating doctor at Safdarjung Hospital has advised implanting a stent after the angiography was conducted, it added. It was also stated that after being released on interim bail, the Trilok Chand Chaudhary immediately took steps for his medical treatment. He visited a clinic on 05.08.2024, then to Fortis Hospital on 08.08.2024 and subsequently was admitted at Apollo Hospital in emergency on 20.08.2024.
It is contended that despite taking regular treatments, the applicant is suffering from uncontrolled diabetes and therefore, no procedure like implanting a stent or surgery could be planned.
It is further stated that, as per the medical reports of the applicant, he has 100 per cent blockage of heart arteries, and therefore, his health condition is vulnerable.
On the other hand, Additional Public Prosecutor (APP) Manish Kumar for the State, assisted by the Counsel for the complainant as well as the Investigation Officer (IO), vehemently opposed the bail application.
It was submitted by the APP that, as per medical prescriptions placed on record, the condition of the applicant was always opined to be stable and no ground is made out for extension of interim bail. (ANI)
